MIAMI CO., Ind. (ADAMS) – Indiana State police say that a Michigan man is now facing a felony OWI charge after allegedly driving drunk at a speed of over 120 mph on U.S. 31 in Miami County on Friday.
According to the Indiana State Police (ISP), at around 11:22 p.m., a trooper conducted a traffic stop on U.S. 31 near County Road 800 N. after spotting a speeding vehicle.
The driver, 34-year-old Brandon Harvey, displayed signs of impairment, failed field sobriety tests and had a BAC of .18%, according to ISP. He is now charged with felony OWI and reportedly had an active warrant at the time of the stop.
Indiana State Police released the following:
Friday night, September 1, 2023, at approximately 11:22 p.m., Trooper Abby Russell was patrolling US 31 near County Road 800 N. when she stopped the driver of a 2018 Mercedes-Benz for driving 121 mph. The driver was identified as Brandon K. Harvey, 34, of Michigan. Harvey had an active warrant out of Cass County. Harvey displayed signs of impairment and failed field sobriety tests. Further investigation revealed he had a preliminary BrAC of .18%.
Trooper Russell transported Harvey to a local hospital, where he refused to submit to a certified test. A subsequent Miami County Superior II search warrant for a blood test was granted and later executed. The results of that test are pending. Trooper Russell transported Harvey to the Miami County Jail.

All criminal defendants are to be presumed innocent until and unless proven guilty beyond a reasonable doubt in a court of law.
